Welcome to ParentWise, an AI-powered parenting guidance service operated by HappyCactus, Inc. (“HappyCactus,” “we,” “us,” or “our”). By accessing or using ParentWise (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the Service.

These Terms apply to all users of the Service, including users who create accounts, submit information, or otherwise interact with the Service.

2. Description of the Service

ParentWise provides AI-generated parenting guidance, including advice related to child health, development, education, nutrition, and family wellness. Our AI specialists are powered by large language models and are designed to offer general parenting information tailored to the ages and profiles of children you provide.

ParentWise is not a medical service. The content provided through the Service is for informational and educational purposes only and does not constitute professional medical, psychological, legal, or nutritional advice. Always consult a qualified healthcare professional for medical concerns about your child.

3. Accounts and Access

ParentWise is currently invite-only. To access the Service, you must receive a valid invite code from HappyCactus or an existing user. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to keep that information current. You must notify us immediately at hello@happycactus.ai if you believe your account has been compromised.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Submit false, misleading, or fraudulent information about yourself, your children, or your family;
• Attempt to reverse-engineer, scrape, or otherwise extract data or models from the Service;
• Interfere with or disrupt the integrity or performance of the Service;
• Use automated scripts or bots to access the Service without our express written permission;
• Upload or transmit viruses, malware, or any other harmful code; or
• Impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity.

5. AI-Generated Content Disclaimer

The guidance provided by ParentWise is generated by artificial intelligence. While we strive to provide helpful and accurate information, AI-generated content may contain errors, inaccuracies, or omissions. You should independently verify any important information before acting on it.

ParentWise is not a substitute for professional medical, psychological, legal, or other professional advice. In case of a medical emergency, call 911 or your local emergency services immediately.

6. Children’s Information

ParentWise is a service for parents and legal guardians. Users must be 18 years of age or older to create an account. By creating child profiles within the Service, you represent and warrant that you are the parent or legal guardian of each child whose information you enter, and that you have the right to provide such information on their behalf.

We handle children’s information in accordance with our Privacy Policy, including applicable requirements under the Children’s Online Privacy Protection Act (“COPPA”).

7. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are and will remain the exclusive property of HappyCactus, Inc. and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

By submitting information or content to the Service (including child profiles, questions, and chat messages), you grant HappyCactus a limited, worldwide, royalty-free license to use that information solely to provide and improve the Service. We will not sell your personal content to third parties.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

You agree to defend, indemnify, and hold harmless HappyCactus, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms, without notice or liability. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California for the resolution of any disputes arising out of these Terms or the Service.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the “Last updated” date above and, where appropriate, by sending an email to the address associated with your account. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
